Warning Letter to Canada Services Border Agency (CBSA)

CBSA is the operator of pipeline facilities crossing the international boundary near Climax, Saskatchewan pursuant to the Orders. As part of the National Energy Board’s (NEB) compliance verification activities and assessment of regulatory requirements, the NEB has found CBSA to be non-compliant with the Accountable Officer and Annual Report Notifications under sections 6.2 and 6.6 of the National Energy Board Onshore Pipeline Regulations (OPR).

On 07 March, 2014, the NEB sent out a notification letter to all companies, including CBSA, as a reminder of the requirements under sections 6.2 and 6.6 of the OPR. Notification of the Accountable Officer under section 6.2 is due 30 days after the appointment. Submission of information for the 2013 and 2014 annual reporting years under section 6.6 is due annually on 30 April.

The CBSA has not submitted information to satisfy the requirements of sections 6.2 and 6.6 for the 2013 or 2014 reporting periods. Over the past 12 months, NEB staff have been in contact with Information not available of CBSA on several occasions, and held an Information Exchange Meeting in September 2014, to clarify regulatory requirements and request information to obtain compliance.

As CBSA remains non-compliant with these requirements to date, we ask that you forward the necessary information by 15 September 2015 to:
