Building Canada Act Assessments
- BCA requires the Minister to consult CER Commission on regulatory conditions attached to approval of a Project in the National Interest (PNI).
- PNI approval requires Commission to be satisfied that the project will not compromise safety and security of persons or regulated facilities.
- The Minister must consult the Commission before amending any conditions.
Ongoing CER-MPO Collaboration
- CER working closely with MPO and IAAC to develop a process for CER-led and integrated assessments under the BCA.
- Work includes developing a process for a new west coast bitumen pipeline contemplated under Canada-Alberta Memorandum of Understanding.
Increasing Regulatory Efficiency
- MPO mandate includes driving changes to Canada’s regulatory and decision-making processes to streamline approvals and increase regulatory efficiency.
- CER is working closely with MPO and IAAC to identify options and measures to increase efficiency of the existing regulatory system.
Integrated Reviews of Designated Projects
- Impact Assessment Act’s Physical Activities Regulations requiring an integrated review (IAAC-led with CER support) for projects with more than 75 km of new right-of-way apply to BCA applications.
- Ongoing discussions between CER, IAAC, and MPO to streamline integrated review process.
- Since 2019, there have been no applications for projects subject to an integrated review.Footnote *
