The Canada Energy Regulator (CER) regulates interprovincial and international pipelines and powerlines, offshore renewable energy projects, oil and natural gas operations in frontier areas, and energy trade. The Privacy Act

The Privacy Act (the Act) gives individuals the right of access to information about themselves held by the federal government, with certain specific and limited exceptions. The Act protects an individual's privacy by setting out provisions related to the collection, retention, use and disclosure of personal information.

In accordance with section 72 of the Act, the head of every federal institution is required to submit an Annual Report to Parliament on the administration of the Act following the close of each fiscal year. The Annual Reports are then tabled in Parliament pursuant to section 72 of the Act. This report describes how the CER fulfilled its privacy responsibilities during the fiscal year 2024-2025.

Organizational Structure

Privacy requests at the CER are processed by the Access to Information and Privacy (ATIP) Office, which is part of the Open Government Team. The Open Government Team reports to the Vice President (VP), Data and Information Management, who is the primary delegated ATIP Coordinator. As of the end of 2024-2025, the CER had four full-time ATIP Officers who allocated their time to activities related to the Act.

Privacy requests are received primarily through two channels; e-mail and the ATIP Online Request Service (AORT). Requests are also occasionally received through the mail. Requests received through the mail are logged into the CER’s records management system by the Records Management team and then forwarded to the ATIP Office.

The CER was not party to any service agreements under section 73.1 of the Privacy Act during the reporting period.

Delegation Order

The CER Act designates the CER Chief Executive Officer (CEO) with the authority to exercise the powers, duties, and functions of the Act. The CEO has historically subdelegated this authority. The ATIP team reports to the VP Data and Information Management to whom the CER CEO’s authority under the Act has been delegated.

The delegation did not change from the previous reporting year. Under the current order, four Executive positions have been delegated full authority under the Act. They are the VP, Data and Information Management (primary ATIP Coordinator), the VP, People and Workforce, VP Secretary of the Commission and VP Communications and Engagement (alternate ATIP Coordinators). The Director of Open Government has also been delegated full authority (last resort ATIP Coordinator). The Group Leader ATIP has limited authorization under section 9. From an operational standpoint, granting these authorities to six individuals ensures that files can be reviewed and signed-off without undue delay.

Performance 2024-2025

In 2024-2025, the CER received six new requests under the Act and carried forward one outstanding request from the previous reporting period.

Of the four closed requests to which responses were given during this period, one request or 25% was completed within the legislated 30-day timeline. Two requests or 50% were completed within 60 days, and one file required extension due to the large volume of documents requested.

As of the last day of the reporting period, three requests remained outstanding from the 2024- 2025 fiscal year with one still within legislated timelines.

Over the last five years the CER has received very few privacy requests. The four requests that were closed this fiscal year resulted in 1165 pages being processed and 779 pages being released.

$44,172 in salary costs to administer the Act and an additional $39,984 for a professional services contract, for a total of $84,156.

In 2024-2025, the CER closed four privacy requests. Of the requests closed during the reporting period, all 100% were disclosed in part.

During 2024-2025 most work was completed remotely with minimal disruption. Processing times continued to be hindered by outdated ATIP redaction and case management software. The ATIPXpress software as a service is scheduled to be in place in early 2025-2026. The new software will improve processing times as it will automate de-duplication.

Training and Awareness

Training continues to be an area of focus for the CER ATIP Office. In 2024-2025, the ATIP Office contracted three targeted training sessions for the Commissioners, Senior Management and ATIP Practitioners. The hybrid work environment and new technologies continued status quo through to March 31, 2025.

During 2024-2025, the CER continued to require that all CER staff and contractors successfully pass the Access to Information and Privacy Fundamentals – COR502 course offered by the Canada School of Public Service (CSPS). During this reporting period, 51 CER employees and contractors registered for the course with all completing it successfully.

Training also focused heavily on employees’ obligations under the Privacy Act with respect to protection of personal information. There was a slight increase in privacy breaches due in part to training and efforts to increase awareness board wide.

In this regard, the CER also reviewed its internal privacy breach procedures and practices to ensure CER staff are aware of their obligations in the event of a privacy breach. The CER uses Treasury Board Secretariat of Canada’ privacy breach management procedures and available suite of tools to assist in managing breaches.

Policies, Guidelines, Procedures and Initiatives

Documentation and training materials on the CER ATIP program were updated and made available through the corporate dashboard, along with links to other materials, such as the Acts, Treasury Board Secretariat of Canada policies and guidance documents, and a range of information management and guidance tools.

The CER continued to examine its ATIP Program and all procedures to enable continuous improvement and to identify opportunities for efficiencies in processing access to information and privacy requests.

Initiatives and Projects to Improve Privacy

During 2024–2025, active participation on the departmental Change Advisory Review Board by the Director of Open Government has increased awareness of Privacy Impact Assessments and their purpose.

The CER is currently reviewing its processes for completing privacy impact assessments, to ensure that these are completed in a timely manner and the summaries properly posted on the CER website.

The service as a software ATIPXpress has been acquired and is scheduled to be in place in early 2025-26, to improve processing times and take advantage of de-duplication capabilities.

Summary of Key Issues and Actions Taken on Complaints

During 2024–2025, there were three new complaints registered and established as founded. The ATIP Office discussed complaint procedures with the Office of the Privacy Commissioner to gain insight as well as understanding expectations for the handling of large volume requests.

The CER will continue to work closely with the Office of the Privacy Commissioner to resolve any future complaints in a timely and efficient manner.

No appeals were made to the Federal Court of Canada during 2024–2025.

Monitoring Compliance

For requests received in 2024-2025, the CER achieved a completion rate of 75%. The CER processed a total of 1165 pages and disclosed 779 pages to requesters.

The Director Open Government meets weekly with the ATIP Team for full case reviews. This includes discussions regarding technical issues, status/progress updates and the timeliness of processing requests.

These findings are regularly communicated to the ATIP Coordinator. All requests are tracked in a central repository reviewed and updated weekly, as well as shared with the Senior Management Committee.

Monthly statistical reports are provided by the ATIP Team to the Director of Open Government. These statistics are presented to the ATIP Coordinator responsible for the oversight of the ATIP program.

Material Privacy Breaches

There were four privacy breach investigations completed by the CER’s ATIP Office during 2024-2025. The four incidents involved emails containing personal information being distributed to incorrect recipients or more recipients than necessary. One incident was determined to be a non-material breach and in a second incident it was determined there was no breach. Two more incidents were treated as privacy breaches due to the visibility of the subject line however it was determined that no breach occurred of the contents or associated attachments. The CER has created a culture of safety and continuous learning when reporting a potential privacy breach as evidenced by three investigations being internally initiated.

The ATIP Office applied the Treasury Board Secretariat of Canada’s privacy breach management procedures and worked with the relevant Office of Primary Interest and ATIP Coordinator to identify and implement administrative measures to mitigate the potential for future incidents. This has helped the CER improve its handling and classification of personal information, as well as its information management practices.

Privacy Impact Assessments

During the 2024-25 reporting period, no privacy impact assessments were completed.

The CER posts summaries of completed privacy impact assessments on the web and forwards copies of completed assessment reports to the Office of the Privacy Commissioner, Privacy Impact Assessment Summaries.

Public Interest Disclosures

The CER did not disclose any personal information under paragraphs 8(2)(e) or (m) of the Privacy Act.

and the Privacy Act

I, the Chief Executive Officer of the Canada Energy Regulator, pursuant to subsection 95(1)of the Access to Information ActFootnote 1 and subsection 73(1)of the Privacy ActFootnote 2, hereby designate the persons holding the positions set out in the Delegation of Authority Schedule attached hereto, or the persons occupying those positions on an acting basis, to exercise the powers, duties and functions of the Chief Executive Officer of the Canada Energy Regulator under the provisions of the Acts and related regulations set out in the schedule opposite each position. This designation supersedes all previous delegation orders.
