The CER is a departmental corporation and agent of the Crown:

  • Subject to broader Government of Canada policy, as applicable and respecting the Commission’s independent adjudicative role.
  • Regularly works with other government departments/agencies in the interest of policy development and delivery of legislated mandate to support policy coherence and coordinate activities.
    • Senior level interactions occurs primarily at the Deputy Head level.

The CER’s governance structure, depicted here, includes:

  • Commission (Court of Record): Responsible for making independent adjudicative decisions and recommendations.
  • CEO (Deputy Head): Responsible for the management of the CER’s day-to-day operations; leads external engagement, interactions with federal and provincial counterparts, and serves as the primary CER spokesperson; and appears before committees.
  • Board of Directors (Governance Board): Responsible for the governance of the Regulator and its governance functions. The Board does not engage in routine operations and is focused on organizational results and outcomes.
  • Indigenous Advisory Committee (External Committee): Advises the Board on how best to enhance the involvement of Indigenous Peoples in respect of CER regulated infrastructure and other matters.
