Addendum to the Memorandum of Understanding between Fisheries and Oceans Canada and the National Energy Board for Cooperation and Administration of the Fisheries Act and the Species at Risk Act Related to Regulating Energy Infrastructure

With reference to the signed 16 December 2013 Memorandum of Understanding between Fisheries and Oceans Canada and the National Energy Board for Cooperation and Administration of the Fisheries Act and the Species at Risk Act Related to Regulating Energy Infrastructure, Fisheries and Oceans Canada (DFO) and the Canada Energy Regulator (CER), formerly the National Energy Board, hereinafter referred to as the “Parties”, are in the process of renewing the Memorandum of Understanding (MOU) to reflect the August 2019 legislative changes of the Fisheries Act and the Canadian Energy Regulator Act.
While the work on the renewal of the MOU is on-going, the Parties agree to vary Section 4.c.i. of the MOU.
Specifically, the Parties agree that the appropriate DFO regional triage offices shall now receive referrals with respect to all activities proposed to occur in the critical habitat of listed aquatic species at risk (see DFO’s Aquatic species at risk map) directly from the proponent.
This change to the procedure is effective as of October 27, 2021 and will remain in place until a new MOU is signed.
Notwithstanding this change, both Parties will continue to fulfill all other terms of the MOU and nothing in the arrangement varies the responsibilities of DFO, any other Minister, or any obligations of the CER under the Species at Risk Act.
The Parties have signed this addendum to the MOU, in counterpart, on the dates indicated below.
