Conditions

FAQs

What are conditions?

Conditions are legal requirements that a company must meet to be allowed to construct and operate a project. Conditions are project-specific and are created to protect the public and the environment.

The NEB has imposed 89 conditions on this project that strengthen public safety, protection of the environment, and ensure continued consultation between the company, landowners and Indigenous communities. Enbridge met all pre construction conditions.

The Line 3 Replacement Program Project has three sets of conditions. The first set applies to the Certificate of Public Convenience and Necessity that was issued under section 52 of the NEB Act. [Filing A80884].

The second set of conditions were imposed as part of the Order issued under section 58 of the NEB Act. These conditions are also in the Recommendation Report [Filing A76575], on page 246 of 274.

The third set of conditions applies to the Decommissioning Order issued under section 45.1 of the OPR. These conditions are also in the Recommendation Report [Filing A76575], on page 256 of 274.

Each authorization, and associated conditions for the Line 3 Replacement Program Project, are located in the Certificate and Compliance Folder [Filing A80884]

How does the NEB know that the conditions have been met?

Most of the conditions attached to the Certificate of Public Convenience and Necessity and the associated Orders require Enbridge to file documentation with the Board to demonstrate compliance. In some cases, the Board will need to review and approve the documentation before Enbridge can move forward. You can review these documents and any related NEB correspondence here [Folder 2985609].

Conditions may require a company to submit documentation such as:

  • results of additional environmental and socio-economic assessments, species-specific studies, or traditional land use investigations;
  • engineering design details, and supporting assessments or information;
  • environmental protection plans;
  • mitigation and monitoring documentation;
  • construction schedules and progress reports; and
  • employee training programs and manuals.

The NEB evaluates the information provided by the company against the specific requirements that must be met for each condition and follows up with the company if more information is needed.

Can the public provide input on whether or not the information filed by Enbridge satisfies a particular condition?

Yes. If you have concerns or are directly impacted by the Board’s decisions on specific condition compliance filings, we strongly encourage you to raise your concerns directly with Enbridge as soon as possible. If you have unresolved concerns about a condition compliance filing, you can submit your comments to the NEB by writing to the Secretary of the Board and copying the company on your submission. Comments should be submitted in a timely manner.

If you need help filing your comments, please contact a Process Advisor at Line3Replacement@cer-rec.gc.ca

The Board will read and consider your input. Enbridge will also be provided an opportunity to respond to these comments. The NEB will decide if further actions are needed on a case-by-case basis and share any next steps publicly.
