Regulatory Stock Review Plan: Export and Import Regulatory Framework
Enabling act(s): Canadian Energy Regulator Act (CER Act)
Rationale: The regulations are being updated to align with the CER Act and to reflect previous stakeholder feedback.
Narrative: On 6 July 2012, the Government of Canada enacted the Jobs, Growth and Long-Term Prosperity Act which made amendments to the NEB Act that affects the NEB’s export and import regulatory framework.
On 28 August 2019, the CER Act came into force. The CER Act contains similar regulation making authorities as the repealed NEB Act with respect to the federal export and import regulatory framework.
The regulations included in this proposal are:
- National Energy Board Act Part VI (Oil and Gas) Regulations
- National Energy Board Electricity Regulations
- National Energy Board Export and Import Reporting Regulations
- Toll Information Regulations

Targeted start for review: 2019
Stakeholder Feedback: Engagement on proposed changes was conducted from August to October 2013. Stakeholders asked that the NEB continue to make export and import data available for their use, and to continue to develop the draft regulations with a view towards maintaining stability across the systems. These comments are being revisited as part of the 2019 review.
