On 11 November 2025, Trans-Northern Pipelines Inc. (TNPI) submitted a letter regarding its 7 August 2025 application to vary Order AO-001-SO-T217-03-2010 (Order) to remove the pipeline listed at line 1 of Schedule C. TNPI stated in the letter that, as it is awaiting a decision from the Canada Energy Regulator on its application, it would not submit the engineering assessment required by Condition 3.c of the Order, which was due by 31 December 2025.
The Commission of the Canada Energy Regulator notes that, rather than requesting an exemption from Condition 3.c, TNPI took the approach of informing the Commission that TNPI would not comply with the requirement. The Commission reminds TNPI that it is required to comply with all conditions of the Order unless it has requested and obtained Commission approval for an exemption or a variance in advance of an applicable deadline. Failure to comply with a condition may result in enforcement action.
In this case, given that the Commission continues to assess TNPI’s variance application, including information that would form part of the annual engineering assessment, the Commission finds that it was unnecessary for TNPI to have submitted the annual engineering assessment for the pipeline listed in line 1 of Schedule C. For this reason, the Commission grants TNPI relief from Condition 3.c of the Order for the pipeline listed in line 1 of Schedule C for the 2025 calendar year.
Pending the Commission’s decision on TNPI’s variance application, the Commission reminds TNPI that it is required by the Canadian Energy Regulator Onshore Pipeline Regulations to continue to operate its system in a manner that ensures the safety of persons and the protection of property and the environment. Accordingly, TNPI is always required to address any defects on its pipelines exceeding the limits set out in the Canadian Standards Association Z662 Oil and gas pipeline systems.
